A dissertação de mestrado examina o significado de penas e tratamentos desumanos, em perspectiva de direito comparado. Traça inicialmente o percurso histórico de criação e consolidação do cárcere e do surgimento da pena privativa de liberdade como a mais importante sanção penal moderna, e reconstrói o momento em que foi possível a convergência dos ordenamentos jurídicos ocidentais quanto à proibição de penas e tratamentos cruéis a partir do século XVIII. Identifica o conteúdo do discurso iluminista e o entendimento que se tinha do significado de penas cruéis, quando estas foram utilizadas nas primeiras declarações de direitos. Depois, analisa como se deu a incorporação deste discurso no recém-criado Estado brasileiro. Em estudo jurisprudencial comparado das experiências estadunidense, européia e brasileira, esta pesquisa procura fornecer um panorama atual da temática, identificando as convergências e divergências de entendimento acerca do conteúdo da proibição. Por fim, pontua as diferenças históricas e contextuais que ajudam a compreender a razão pela qual o Brasil dá a estas expressões jurídicas, em particular no que tange à ambiência carcerária, uma abrangência menor do que aquela dada pela Corte Européia de Direitos Humanos ou pela Suprema Corte dos Estados Unidos.

The essay examines the meaning of inhuman punishment and treatment in the perspective of comparative law. At first traces the historical course of creation and consolidation of prisons and the rise of incarceration as the most important modern penal sanction, and rebuilds the moment when it was possible the convergence of occidental juridical laws as far as the prohibition of cruel punishment and treatment since the XVIII century. It identifies the content of Enlightenment speech and the knowledge that it had of the meaning of cruel punishments, when those were mentioned in the first declarations of rights. Then analyses how it was given the incorporation of this speech on the recently-created Brazilian State. Through comparative studies of the American, European and Brazilian case-law, this research tries to provide a current panorama of the subject, identifying the convergences and divergences of understanding concerning the content of the prohibition. Finally, points out the contextual and historical differences which help to understand the reason why Brazil gives to these legal expressions, in particular in what is related to the prison environment, a smaller scope than that which is given by the Human Rights European Court and the United States Supreme Court.
